Only Gestational Surrogacy is Legal in Ukraine

Only gestational surrogacy is allowed in Ukraine, not traditional surrogacy.

What are the differences?

In traditional surrogacy, the surrogate mother’s eggs are fertilized with the sperm from the intended father. With traditional surrogacy, the surrogate is the biological mother of the child. Traditional surrogacy is not legal in Ukraine.

Gestational surrogacy is when a surrogate mother carries an embryo created from the intended parents or one intended parent and a donor. A gestational surrogate is in no way genetically related to the child she carries.

In Ukraine at least one intended parent must be the genetic parent of the child, either the intended mother or father. The intended parent may contribute their own sperm and eggs. They may also use donor eggs and the intended father’s sperm, or the intended mother’s eggs and donor sperm.

This is a law of Ukraine and for most countries, this genetic link is crucial to getting your child through surrogacy citizenship in your country.
